Under BC's Family Law Act, a separation agreement is a legally binding contract that resolves the financial and parenting consequences of separation — property, debt, child and spousal support, and parenting arrangements — all without going to court. For an agreement to be enforceable, both parties must make full financial disclosure, sign voluntarily, and have had the opportunity to receive independent legal advice (ILA). We structure every agreement to meet these requirements from the outset.
